What is the Divorce Process Like?

Consultation

Starting the divorce Case

Attending Divorce Court Proceedings
After the divorce petition has been filed, the court will usually schedule the first court appearance in your divorce case. This first divorce court hearing is called an Initial Case Management Conference or “ICMC” for short. At this hearing, the judge will introduce themselves to you and your spouse, and learn more about the case. While this is usually not a time to argue over contested issues, our divorce attorneys will advocate on your behalf at this hearing and ensure that you are prepared to attend.
Mediation
In Minnesota divorces, divorce judges require that all parties going through divorce attend mediation in order to attempt to settle their cases. Mediation is a process through which divorcing spouses meet with a neutral outside party (usually a lawyer or former judge) who attempts to help them reach a settlement that works for both parties. While settling the case through mediation is not always possible, many of our clients in Minnesota divorce cases find this process to be effective and ends up saving them valuable time and money. Divorce trial - attending court
In some cases, our clients do not end up settling their cases prior to trial. This means that a judge must make a decision on the case.
