New Minneapolis Gun Diversion Program, Pathways to New Beginning

There is a new diversion program for people charged and convicted of any gross misdemeanor weapons offense. This new gun diversion program is being implemented by the Minneapolis City Attorney’s Office (MCAO). The program is an alternative sentencing option for defendants with no prior adult convictions, who are convicted of a gross misdemeanor weapons offense. This new gun diversion program, Pathways to New Beginning, was developed by the MCAO and Urban Ventures. The goal of the program is reducing recidivism by addressing the risk factors and needs of criminal defendants. Eligibility Requirements for the Minneapolis Gun Diversion Program:

1. Gross misdemeanor weapons offense in Minneapolis;
2. No prior gun convictions;
3. No prior violent felony convictions;
4. No prior convictions for any crime of violence as defined by Minn. Stat. §624.712.5;
5. No prior convictions for a non-violent felony offense within that last 5 years (property / low-level narcotics);
6. No prior domestic assault or domestic assault related convictions;
7. No prior non-domestic assault convictions within the past 5 years (If case was pled down to a DOC or some other charge it does not make them ineligible even if it occurred within the past 5 years);
8. Not currently on any form of active supervised probation; 

9. No pending felony charge; and
10. Must enter a plea of guilty to the charge.

Outcome for Successful Completion of the Minneapolis Gun Diversion Program

The criminal defendant will receive a sentence of a stay of adjudication for 2 years with conditions such as no same or similar weapon related offenses, no assault or domestic assault related offenses, no new felony offenses, pay $200 in prosecution costs, forfeit the weapon, and complete the program. In the event the defendant does not want to participate in the new gun diversion program, the defendant can follow the negotiations guidelines as outlined in the policy and procedure manual for the offense.

Program Requirements for Pathways to New Beginning  

The new gun diversion program in Minneapolis consists of two phases. The first phase is 12 weeks long with 67 hours of programming to be completed, that consists of 66 hours of group and 1 hour of case management. The second phase is 3-6 months long and requires between 7.5 and 15 hours of programming that consists of 4.5 to 9 hours of group and 3 to 6 hours of case management. The specific length of the second phase is determined by the program.
