Who Must Register as a Predatory Offender in Minnesota?

Pursuant to Minnesota Statute 243.166, subd. 1b., a person must register as a predatory offender if the person was charged with or petitioned for a felony violation of or attempt to violate, or aiding, abetting, or conspiracy to commit, any of the following, and convicted of or adjudicated delinquent for that offense or another offense arising out of the same set of circumstances:

·      Murder in the first degree;

·      Kidnapping;

·      1st, 2nd, 3rd, 4th, and 5th Degree Criminal Sexual Conduct;

·      Indecent Exposure under 617.23, subd. 3;

·      Surreptitious Intrusion described in 609.746, subd. 1(f);

·      Or:

The person was charged with or petitioned for a violation of, or attempt to violate, or aiding, abetting, or inspiring to commit any of the following and convicted of or adjudicated delinquent for that offense or another arising out of the same set of circumstances:

·      Criminal Abuse (Vulnerable Adult) in violation of section 609.2325, subd. 1(b);

·      False imprisonment in violation of 609.255, subd. 2;

·      Solicitation, inducement, or promotion of the prostitution of a minor or engaging in the sex trafficking of a minor in violation of 609.322;

·      A Prostitution offense in violation of 609.324, subd. 1(a);

·      Soliciting a minor in a sexual performance in violation of 609.352, subd. 2 or 2a(1);

·      Using a minor in sexual performance in violation of 617.246; or

·      Possessing Child Porn in violation of 617.247;

·      The person was sentenced as a patterned sex offender under 609.3455, subd. 3a; or

What if I was Charged with a Crime that Requires Me to Register as a Predatory Offender, but I was Convicted of a Crime that Does Not Require Registration? 

In Minnesota, you may be required to register as a Predatory Offender even if you plead guilty to a crime that does not require registration if the Court made a finding probable cause exists for the offense that would require registration if you were convicted, if the other offense arose out of the same set of circumstances. As an example, you are required to register as a Predatory Offender if you were charged with kidnapping, the Court entered a finding of probable cause for kidnapping, and you later plead guilty to disorderly conduct out of the same circumstances as the kidnapping charge.

Who Decides if I have to Register as a Predatory Offender?

In Minnesota, the Bureau of Criminal Apprehension (BCA) determines whether a person convicted of a crime is required to register as a Predatory Offender. Most often, probation will notify the BCA that the person must be screened for Predatory Registration.

How Long do I Have to Register as a Predatory Offender?

In Minnesota, people required to register as a Predatory Offender either have to register for a period of ten (10) years, or for the remainder of their lifetime, depending on their case.

Predatory Offenders in Minnesota must register their dwelling, motor vehicles, primary address, school, secondary address, treatment facilities, and employment or work.
